Increasingly patent holders need to demonstrate that they are acting as a willing licensor, and as a good “IP citizen”. Within the context of Standards Essential Patents this typically means demonstrating that royalty demands and licensing approaches are FRAND. However there remains limited guidance on FRAND, and it is a topic that the courts continue to refine.
